Once you have decided to instruct us, our efficient and qualified team will proceed with the transaction immediately, as we aim to complete your sale within 6-8 weeks. This will depend on all others in your chain moving as quickly as we will but if you have a particular date/timescale in mind our team will be happy to try and accommodate your needs.
Particulars of Sale
Your Estate Agents will provide us with full details of your property along with the buyer's full name and their Solicitor's details.
Contract Documentation
We are responsible for drafting the Contract, which is the official agreement between the buyer and the seller. This sets out the conditions of sale, which must be adhered to by both parties. Failure to perform or observe the conditions will result in breach of Contract, which may cause financial penalties or rescission.
Pre-Contract Enquiries
The buyers Solicitor will investigate the title to the property and may raise some enquiries as to your ownership and the legal title to your property. You will be required to assist us in answering their enquiries.
Signature of Documents
Once we have satisfied the buyer's enquiries, you will be required to sign the Contract and Transfer Deed in readiness for exchange and completion. We will explain the nature and implications of each document and advise you on the conditions of the contract.
Exchange of Contracts
Exchange is carried out by us with the buyer's legal advisor. The buyer on exchange as a deposit usually pays a full 10% of the purchase price. If a full 10% is not available a lesser amount can be agreed by you.
Once Contracts have been exchanged, both parties are LEGALLY BOUND to complete the transaction.
Financial Statement
We will provide you with a full breakdown of costs before completion, so you are aware of the sale proceeds due back to you (if any).
Completion
This is the 'Moving Day', on which your property will be sold and the ownership will transfer to the buyer once we receive funds from the buyer's lawyers. |
